Terms of Service

1. Agreement

These terms are an agreement between ClaimCompass ("we") and the firm or person that creates an account or uses the service ("you"). If you accept them for a firm, you confirm you are authorized to bind that firm. If you do not agree, do not use ClaimCompass.

2. Accounts and users

You are responsible for your account, for keeping sign-in details secure, and for everything done in your firm's workspace, including by the teammates, outside parties, and API keys you add. Each seat is for one named person and may not be shared. Tell us right away if you suspect unauthorized access.

3. Free trial, subscriptions, and billing

• New firms get a free trial with no card required. If no plan is chosen by the end of the trial, the workspace becomes read-only.
• Paid plans are billed in advance, monthly or annually, through Stripe, based on the firm's plan and number of seats. Seat changes are prorated.
• Prices may change with at least 30 days' notice before your next renewal.
• You can cancel at any time from Settings → Billing; cancellation takes effect at the end of the current billing period. Fees already paid are not refundable except where required by law.
• If a payment fails, the workspace keeps full access for a 7-day grace period while we retry. After that it becomes read-only, with export still available, until the balance is paid. If it stays unpaid for 30 days, access is locked.
• Prices do not include taxes, which are added where required.

4. AI usage

Each plan includes a monthly AI allowance shared across the firm. When it is used up, built-in AI features pause until the next billing period or until you change plans; everything else keeps working. AI output may be inaccurate or incomplete, and you are responsible for reviewing it before relying on it or sending it to anyone.

5. Your data

You own the data you and your users put into ClaimCompass. You give us permission to host, process, and display it only to provide and support the service, as described in our Privacy Policy. You are responsible for having the rights and consents needed to upload it, including consents for recording calls where the law requires them. You can export your data at any time while your account is active and for 30 days after it closes.

6. Acceptable use

You agree not to:

• break the law, including insurance, licensing, privacy, anti-spam, and call-recording laws;
• upload malware or content you have no right to share;
• try to access other firms' data, probe or break our security, or overload the service;
• reverse engineer the service or use it to build a competing product;
• resell access without our written permission.

7. Your professional responsibility

ClaimCompass is software. It does not provide legal, adjusting, or insurance advice, and it does not act as a public adjuster. Deadlines, reminders, templates, and AI drafts are aids; you remain responsible for your licensing, your contracts with clients, and every communication and filing you make.

8. Third-party services

Some features connect to services you choose, such as Google, Microsoft, Twilio, or Stripe. Your use of those services is governed by their terms, and we are not responsible for them. If a provider changes or discontinues its service, the related feature may stop working.

9. Availability and changes

We work to keep ClaimCompass available and secure, but it may occasionally be unavailable for maintenance or reasons outside our control. We may improve or change features; we will not materially reduce the core functionality of a paid plan during a paid term without notice.

10. Suspension and termination

You may stop using ClaimCompass at any time. We may suspend or end access if you materially breach these terms, fail to pay, or create a security or legal risk, and we will give notice where reasonable. Sections that by their nature should survive termination (such as payment, data export, disclaimers, and limits of liability) survive.

11. Disclaimers

Except as expressly stated in these terms, ClaimCompass is provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows.

12. Limitation of liability

To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, and our total liability for any claim relating to the service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. These limits do not apply to your payment obligations or to either party's fraud or willful misconduct.

13. Indemnity

You will defend and indemnify ClaimCompass against third-party claims arising from your data, your use of the service in breach of these terms, or the professional services you provide to your clients.

14. Changes to these terms

We may update these terms. We will post the new version here and, for material changes, notify account owners at least 30 days before they take effect. Continuing to use ClaimCompass after that means you accept the updated terms.

15. General

These terms and our Privacy Policy are the entire agreement between us about ClaimCompass. If any part is unenforceable, the rest stays in effect. Neither party may assign these terms without the other's consent, except as part of a merger or sale of its business. Not enforcing a term is not a waiver of it.
